Alleged breach of Court Order:  We’ll push for contempt of court case – RTEAN President’s Counsel

 

  • Barrister Olayiwola Afolabi, the Lead Counsel to the Road Transport Employers Association of Nigeria (RTEAN) President, Comrade Eriyo Osakpmwan, Thursday in Abuja, threatened to push a contempt of court case against a faction of the RTEAN led by the former Lagos State chairman, Alhaji Musa Mohammed,  over alleged breach of order of the National Industrial Court (NIC) restraining them from parading themselves as officials of the transport association.

Olayiwola said he would  file a motion to commute the factional leader and his members to prison for their disobedience.

Afolabi, who led Barrister Eze Simon and Barrister A. S . Garba, to the Industrial Court on behalf of Comrade  Osakpmwan, maintained that nobody is bigger than the law of the land, saying they would ensure that the rule of law and order of the National Industrial Court is obeyed.

He said it was laughable for Mohammed’s faction  to be evading service by the court baillif,  who, according to him, had been in Lagos for close to one month now , just to serve Musa Mohammed and his faction the court order.

Afolabi said, “It is really funny for them to be evading service by the court baillif for about four weeks now. We are also approaching the court for a substituted service.We have also filed a motion on notice before the court on the breach of order, So, the next thing will be a commute to prison for failing to obey court order.

“Let me thank all the members of Road Transport Employers Association of Nigeria that came all over the country for the case today in Abuja, we have been made to understand that, the case is still with the Acting President of NIC, that both parties will be communicated on a date to be fixed.

“But the most important thing here now is that, the restraining order still remains, which gives it live to enforce the court order. So, as we speak , the only recognised Executive National President of RTEAN, is Comrade Eriyo Osakpmwan, anybody who parades himself as president, is close to prison.”

It would be recalled that the National Industrial Court had earlier restrained the former Lagos state chairman, Alhaji Musa Mohammed and six others from parading themselves as officers or having any dealings to do with the Association.
